Smith and Chaddock obtain defense verdict for surgeon

Quinn Johnston attorneys Matt Smith and Adam Chaddock obtained a defense verdict for a surgeon.

Defendant surgeon was accused of failing to diagnose a leak in a post-Roux-en-Y bariatric surgery patient, resulting in sepsis and death. Surgeon identified and repaired incidental hole in residual stomach during surgery; autopsy found hole near same location postmortem. Defendant said patient’s post-op symptoms were more consistent with normal postoperative bleeding, not leak.

Plaintiff asked jury for $9.2 million at conclusion of 8-day trial. Defense verdict returned after just under 2 hours of deliberations.
