Professional Liability and Professional Licensing Defense

Quinn Johnston defends the reputations and livelihoods of attorneys, accountants, medical practitioners, psychologists, architects, engineers, social workers and other licensed professionals accused of malpractice, breaches of fiduciary duty, disciplinary violations or other misconduct. We offer aggressive and discreet representation for our professional colleagues.

Legal Malpractice Defense Attorneys

Attorneys in every area of practice work long, hard hours trying to obtain the best possible outcomes for their clients.  As every lawyer knows, positive outcomes are never guaranteed, even in the strongest and most hard fought cases.  Our Peoria and Springfield lawyers represent their colleagues facing allegations of breach of fiduciary duties, breach of contract, negligence and other claims.  We vigorously defend attorneys threatened by potentially devastating lawsuits, and we proudly defend our profession in courts of law throughout central Illinois.

Our legal malpractice defense attorneys can assist with cases alleging:

  • Breach of duty of care
  • Breach of fiduciary duty
  • Breach of contract
  • Missed filing deadlines
  • Missed recording deadlines
  • Failure to comply with court rules or statutory requirements
  • Violations of the Illinois Rules of Professional Conduct
  • Failure to maintain client confidences
  • Failure to obtain clear title to property
  • Failure to investigate factual statements
  • Failure to prepare for trial
  • Unfair dealings
  • Mishandling of client funds

Quinn Johnston investigates each legal negligence case thoroughly to determine if an attorney-client relationship existed, if there was a breach of duty of care, if the plaintiff suffered any actual damages, and if the alleged breach of duty proximately caused plaintiff’s damages.  When a plaintiff alleges legal malpractice in litigation (the so-called “case within a case”), we also investigate if the plaintiff had any chance of recovering damages in the original lawsuit.  Unless a plaintiff can prove he or she would have recovered damages in the original lawsuit, it can be difficult to recover damages in a legal negligence suit.

Our firm can also assist attorneys with responses to complaints made to the Attorney Registration & Disciplinary Commission (ARDC) and can also represent attorneys during hearings before the ARDC.

Defense Against Accountant Malpractice Claims

Quinn Johnston also represents accountants accused of negligence.  These claims often involve allegations that an accountant made an error while conducting an audit, gave bad advice, or made mistakes while preparing tax returns (often discovered during IRS audits).  Claims may allege that an accountant failed to follow GAAP (Generally Accepted Accounting Principles) or GAAS (Generally Accepted Auditing Standards).

If you are an accountant facing allegations of professional negligence, our attorneys can help.  We understand that your livelihood is directly connected to your professional reputation.  We thoroughly investigate cases of professional negligence to evaluate whether an accountant owed a duty to a client, if that duty was breached, if the plaintiff suffered harm as a result of the alleged breach of duty, and if the harm was proximately caused by the alleged breach of duty.

Strong Representation of Licensed Professionals before the IDFPR

In addition to representing clients in court, Quinn Johnston’s Peoria and Springfield attorneys also represent licensed professionals before the Illinois Department of Financial and Professional Regulation (IDFPR).  All licensed professionals are entitled to aggressive and effective representation before the IDFPR.  We aim to obtain a fair resolution in every IDFPR case in which we are involved.  Our clients have a great deal at stake in this type of hearing, and strong representation with realistic expectations is necessary. We bring the same common sense approach to these cases as we do to the courtroom.

At Quinn Johnston, our team of medical malpractice defense lawyers represents doctors, nurses and nurse practitioners, dentists, chiropractors, podiatrists, physician’s assistants, physical therapists, nursing home attendants, pharmacists, medical groups, hospitals and other medical professionals whose careers are threatened by potentially devastating lawsuits.
