Recent Experience
Asbestos-related Injury Claims Defeated: Two of our attorneys recently obtained summary judgment in favor of a premises owner in a wrongful death case. Plaintiff claimed that decedent’s exposure to asbestos at Defendant’s premises caused mesothelioma, resulting in Plaintiff’s decedent’s death. The Court granted summary judgment in favor or our client and several other Defendants. Although Plaintiff appealed the ruling as to several Defendants, he did not seek an appeal of that portion of the Order granting summary judgment in favor of our client.
Seat Belt Injury Claim Rejected in Jury Trial: Following a recent Peoria County trial, Quinn Johnston received a verdict in favor of the defendant. Plaintiff claimed a bladder laceration from her seatbelt and $20,000 in medical expenses. The defense contended that the car accident was Plaintiff’s fault for looking over her shoulder and talking to her husband and son in the back seat, instead of looking forward to see our client’s vehicle protruding ever so slightly into her lane.
Summary Judgment Granted in Industrial Accident: Plaintiff suffered severe personal injuries and incurred over $600,000 in medical expenses as a result of a fall off of the platform of a scissor lift that had been elevated 20 feet in the air to allow Plaintiff to paint the ceiling of a commercial building. Plaintiff filed suit against our client, which was the company that rented the scissor lift, the general contractor and two sub-contractors. Plaintiff’s theory against our client was that it provided a defective scissor lift because someone had removed the end railing prior to Plaintiff’s use of the scissor lift, and Plaintiff testified that the proximate cause of his fall was the lack of the end railing. The court granted our motion for summary judgment on the basis that no conduct on the part of our client was the proximate cause of Plaintiff’s fall.
